União Europeia quer que smartphones tenham 5 anos de suporte garantido

O governo da Alemanha propôs na União Europeia a criação de normas mais rígidas para o suporte de smartphones no continente. Caso seja aprovada, fabricantes de smartphones e desenvolvedores de sistemas como o Android e o iOS deverão garantir que todos os dispositivos comercializados em países europeus tenham no mínimo cinco anos de atualizações e reparos garantidos.

De acordo com o ministério da economia da Alemanha, a iniciativa busca diminuir o impacto ambiental causado pela obsolescência programada dos smartphones, que aumenta consideravelmente o lixo eletrônico e o descarte de componentes na natureza.

Além do suporte estendido aos smartphones, a Alemanha quer que as peças de reposição sejam disponibilizadas a um preço razoável para os consumidores. A proposta sugere que peças de reposição obrigatória, isto é, aquelas que garantem o funcionamento do smartphone, permaneçam no mercado por no mínimo cinco anos. Já as peças de reposição para tablets devem estar disponíveis por no mínimo seis anos. O projeto ainda prevê que estas peças não sofram reajustes anuais nos preços, tendo valores pré-fixados pelas fabricantes.

Prazos mais rápidos para a entrega das peças

Além de regulamentar o suporte técnico dos smartphones, a Alemanha quer estipular normas mais rígidas no prazo de entrega das peças aos consumidores. O projeto apresentado na União Europeia prevê que as fabricantes terão prazo máximo de cinco dias para entregar peças de reposição aos distribuidores autorizados.

Apesar da proposta, o porta-voz do governo alemão destaca que este prazo pode ser discutido para alcançarem um intervalo razoável para os consumidores e fabricantes. Caso o fornecimento das peças não aconteça no prazo estipulado, os consumidores terão direito a troca gratuita do smartphone.

Direito ao reparo de smartphones

A proposta de expansão da vida-útil dos smartphones não é uma exclusividade da União Europeia. Há alguns meses, nos Estados Unidos, o congresso americano aprovou a proposta de uma lei popularmente chamada de “direito do reparo” que obriga as fabricantes de dispositivos eletrônicos a fornecerem peças para que consumidores efetuem trocas e reparos nos produtos. A medida também proíbe a utilização de padrões e colas que dificultam a abertura de smartphones por terceiros.

Fabricantes antecipam mudanças na legislação

Para antecipar estes embates jurídicos, o Google tem trabalhado para expandir o suporte dos dispositivos com Android. No ano passado, a empresa fechou uma parceria com a Qualcomm – fabricante dos SoCs Snapdragon para a criação do projeto Treble, iniciativa que busca aprimorar a arquitetura dos seus processadores para que, no futuro, a maioria dos dispositivos receba as mesmas atualizações do sistema operacional. A ideia é que mesmo com a diversidade de fabricantes, os dispositivos recebam a mesma versão do sistema por até quatro anos, algo similar ao que vemos com o iOS no iPhone.

Além disso, a Samsung também declarou que trabalha em otimizações dos processadores Exynos para que smartphones fabricados a partir de 2020 recebam no mínimo 29 meses de atualizações.
